The Temporary Foreign Worker Program of the United States of America, specifically classified as H2, allows the American Employer to hire foreign workers for a certain period of time to cover certain positions in their companies.
The H2 Visas are issued to unskilled workers (not professionals) to work for short periods of times in the United States in a legal way.
H-2A: Temporary Agricultural Workers (seeding and harvesting). The H-2A visas does not have a cap.
H-2B: Temporary Non Agricultural Workers (landscaping, construction, cleaning, welding). The H-2B visas are limited to a cap determined by the Congress of 66,000 issued yearly.
H-2R: Returning workers that have held an H2-B visa. The procedure that has tom be done by the Company is faster. The requirements are slightly different from the H2-B visa.
It is important to remember that in order to be able to hire non-American employees, you must have authorization from the Department of Labor (DOL) and the U.S. Citizenship and Immigration Services (USCIS).
